These Terms of Service ("Terms") govern your access to and use of the Chitin web application firewall software and related services (the "Service"), provided by Chitin ("Chitin", "we", "us"). By creating an account, installing the Service, or otherwise using it, you agree to these Terms. If you are entering into these Terms on behalf of an organisation, you represent that you have authority to bind that organisation.
Chitin provides web application firewall and host intrusion prevention software for Windows Server / IIS environments, together with related management, updates and support as described on chitinweb.com and in your selected plan. The Service is self-hosted: it runs on servers you own or control. We may improve, modify or discontinue features from time to time.
You must provide accurate account information and keep it current. You are responsible for safeguarding your credentials and for all activity under your account. You must be legally capable of entering into a binding contract to use the Service.
Subject to these Terms and payment of applicable fees, we grant you a non-exclusive, non-transferable, revocable licence to install and use the Service on the number of servers permitted by your plan, solely for protecting your own systems or systems you are authorised to protect. Your use is also governed by our Acceptable Use Policy, which is incorporated into these Terms. You may not resell, sublicense, reverse engineer, or circumvent licensing controls of the Service except as expressly permitted or required by law.
Paid plans are billed per protected server on a recurring (typically monthly) basis, in advance, in the currency stated at purchase. Fees are non-refundable except where required by law or expressly stated. We may change pricing on renewal with reasonable notice. You are responsible for any applicable taxes. Non-payment may result in suspension or termination of the Service.
Support is provided at the level associated with your plan. Except where a written service-level agreement expressly states otherwise, the Service is provided without any guarantee of uninterrupted availability. Because the Service runs on your infrastructure, availability of your sites depends primarily on your own systems.
Our handling of information you provide to us is described in our Privacy Policy. Traffic inspected by the Service, and logs it generates, are processed on your own servers and remain under your control; we do not receive that data unless you choose to share it with us (for example, when requesting support).
The Service, including its software, rulesets configuration, documentation, branding and the Chitin name and logo, is owned by Chitin or its licensors and is protected by intellectual-property laws. These Terms grant you a licence to use the Service, not ownership of it. Third-party and open-source components are used under their respective licences.
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. No security product can guarantee that every attack will be detected or prevented; you remain responsible for your overall security posture.
To the maximum extent permitted by law, Chitin will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total aggregate liability arising out of or relating to the Service will not exceed the fees you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim.
You agree to indemnify and hold harmless Chitin and its personnel from claims, damages and expenses arising out of your use of the Service in breach of these Terms or applicable law, or your infringement of the rights of any third party.
These Terms apply while you use the Service. You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or the Acceptable Use Policy, non-payment, or where required by law. On termination, your licence ends and you must cease using the Service; provisions that by their nature should survive (such as fees owed, intellectual property, disclaimers and limitations of liability) will survive.
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by posting the updated Terms with a new "last updated" date, or by email). Your continued use of the Service after changes take effect constitutes acceptance.
These Terms are governed by the laws of the Emirate of Ajman and the applicable federal laws of the United Arab Emirates, without regard to conflict-of-laws principles. The courts of Ajman, UAE, will have jurisdiction over any dispute, subject to any applicable free-zone rules.
